The first week after a crash: what actually matters

Most of the advice online is generic. Here is what genuinely protects you in the days right after an accident, and what quietly hurts your case.

The hours and days after a crash are a blur for most people. You are dealing with pain, insurance calls, a wrecked car, and the start of a process you did not ask to be in. A few things you do in this first week have outsized effects later.

Get checked even if you feel okay

Adrenaline hides injuries. People walk away from crashes feeling fine and wake up two days later barely able to move their neck. Beyond the health reason, there is a claim reason. If you wait two weeks to see a doctor, the insurer will argue your injury came from something else. Prompt medical care creates the record that connects the crash to the injury. This is true whether it was a rear-end hit or a more serious side impact.

Be careful what you say to the other insurer

The at-fault driver's insurance company will often call fast and friendly, sometimes within a day. They may ask for a recorded statement. You are not required to give one, and saying the wrong thing casually can be used against you later. A simple "I am still being treated and not ready to discuss this" is a complete answer. Let your attorney handle them.

Document everything while it is fresh

Photos of the scene, the vehicles, your injuries, the road. The police report number. Names and numbers of witnesses. Keep a simple log of how you feel each day and what you could not do because of the injury. Memories fade and cases sometimes do not settle for a year or more, so the contemporaneous record is worth a lot.

Get a lawyer before you sign anything

Do not sign a release or accept a quick check without legal advice. Early offers are almost always low, designed to close the case before you know what it is worth. Most personal injury attorneys work on contingency, meaning no upfront cost. And once you have an attorney and a pending case, if the bills get overwhelming during the wait, pre-settlement funding becomes an option. The how it works page explains that process.
